PARTICIPANT WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION AGREEMENT (Governing Law: State of California) PLEASE READ THIS AGREEMENT CAREFULLY BEFORE SUBMITTING YOUR BOOKING INQUIRY. BY CHECKING THE BOX BELOW, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY ALL TERMS OF THIS AGREEMENT. 1. PARTIES This Agreement is entered into between Vanja Spaić Nunes Athletics, LLC ("VSN Athletics," "Coach," "we," or "us") and the undersigned parent or legal guardian ("Parent/Guardian") on behalf of themselves and the minor athlete identified in the booking form ("Athlete," and together with Parent/Guardian, "Participant"). 2. DESCRIPTION OF ACTIVITIES Participant desires to participate in athletic training activities offered by VSN Athletics, including but not limited to: javelin throw instruction, shot put instruction, discus throw instruction, general throwing fundamentals coaching, youth athletic development sessions, small-group training, virtual coaching sessions, video analysis, throws clinics, and any related warm-up, conditioning, movement preparation, or cool-down activities (collectively, "Activities"). 3. ASSUMPTION OF RISK Participant acknowledges and agrees that participation in the Activities involves inherent risks, dangers, and hazards, including but not limited to: physical exertion; muscle strains, sprains, and tears; joint injuries; impact injuries from implements or equipment; falls; overuse injuries; heat-related illness; and other injuries that may result in serious bodily harm, permanent disability, or death. Participant voluntarily and knowingly assumes all such risks, whether known or unknown, foreseen or unforeseen, arising from participation in the Activities. California Civil Code Section 1714.9 and related statutes may limit the enforceability of certain liability waivers in specific circumstances. Participant acknowledges awareness of this and nonetheless voluntarily agrees to the terms herein to the fullest extent permitted by applicable California law. 4. RELEASE OF LIABILITY To the fullest extent permitted by California law, Participant, on behalf of themselves, their heirs, personal representatives, assigns, and next of kin, hereby releases, waives, discharges, and covenants not to sue VSN Athletics, Vanja Spaić Nunes, and their respective officers, agents, employees, volunteers, successors, and assigns (collectively, "Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever, arising out of or related to any loss, damage, injury, or death that may be sustained by Participant, or to any property belonging to Participant, whether caused by the negligence of the Released Parties or otherwise, while participating in the Activities, or while on the premises where the Activities are conducted. This release does not apply to claims arising from gross negligence, willful misconduct, or intentional acts by the Released Parties, to the extent such claims cannot be waived under California law. 5. INDEMNIFICATION Participant agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or resulting from Participant's participation in the Activities, including claims arising from Participant's own negligence, to the extent permitted by California law. 6. MEDICAL AUTHORIZATION In the event of an emergency, Participant authorizes VSN Athletics and its representatives to seek and consent to emergency medical treatment on behalf of the Athlete if Parent/Guardian cannot be reached in a timely manner. Participant agrees to be financially responsible for any medical expenses incurred. This authorization does not create any obligation on the part of VSN Athletics to provide or arrange medical treatment. 7. PHOTO AND MEDIA RELEASE Participant grants VSN Athletics permission to photograph or record the Athlete during training sessions and to use such images or recordings for educational, promotional, or marketing purposes, including on VSN Athletics' website and social media channels. Participant may opt out of this permission by notifying VSN Athletics in writing prior to the first session. 8. HEALTH REPRESENTATIONS Participant represents that the Athlete is in good physical health and has no known medical condition that would prevent safe participation in the Activities. Participant agrees to inform VSN Athletics of any medical conditions, physical limitations, or injuries prior to each session. 9. EQUIPMENT AND CONDUCT Participant agrees to follow all safety instructions provided by VSN Athletics, to use only approved equipment, and to conduct themselves in a manner that does not endanger themselves or others. VSN Athletics reserves the right to remove any Participant from a session for unsafe behavior. 10. GOVERNING LAW AND VENUE This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising under this Agreement shall be resolved exclusively in the state or federal courts located in Fresno County, California, and Participant consents to personal jurisdiction in such courts. 11. SEVERABILITY If any provision of this Agreement is found to be unenforceable or invalid under California law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect. 12. ENTIRE AGREEMENT This Agreement constitutes the entire agreement between the parties with respect to the subject matter herein and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written. 13. ACKNOWLEDGMENT BY CHECKING THE BOX BELOW, PARENT/GUARDIAN REPRESENTS THAT: (a) THEY ARE AT LEAST 18 YEARS OF AGE; (b) THEY ARE THE PARENT OR LEGAL GUARDIAN OF THE ATHLETE NAMED IN THE BOOKING FORM; (c) THEY HAVE READ THIS ENTIRE AGREEMENT; (d) THEY FULLY UNDERSTAND ITS TERMS; AND (e) THEY VOLUNTARILY AGREE TO BE BOUND BY IT ON BEHALF OF THEMSELVES AND THE ATHLETE.
